China introduces patent verification for SRDI and Little Giant SME certifications.

Why it matters: Legal advisors must understand these changes as they impact patent validity and eligibility for key innovation certifications within China’s strategic technology sectors.

  • Four Chinese agencies—MIIT, CAC, State Taxation, and CNIPA—issued new patent screening rules on October 23, 2026.
  • Patent counts and quality now strictly verified in SRDI and Little Giant certification evaluation processes.
  • Provincial authorities will coordinate with IP and tax departments to enforce front-end patent screening mechanisms.
  • Falsified data leads to designation revocation and a three-year reapplication ban; intermediary agencies face joint enforcement and public exposure.

On October 23, 2026, China’s Ministry of Industry and Information Technology, Cyberspace Administration, State Taxation Administration, and National Intellectual Property Administration jointly released a notice targeting third-party intermediaries involved in the application materials preparation for the Specialized, Refined, Distinctive, and Novel (SRDI) and "Little Giant" SME certification programs.

These certifications rely heavily on intellectual property metrics, including the number of invention patents and PCT filings, which factor into the SRDI development quality index. The new measures require provincial SME authorities to strengthen verification through coordinated efforts with intellectual property and taxation agencies, establishing a front-end patent screening mechanism.

Local IP authorities will specifically screen for abnormal patent situations during certification reviews. Artificial intelligence and big data tools are slated to support reviewers, helping detect anomalies such as inconsistent data or sudden fluctuations in patent numbers.

The review process also changes structurally: panels are formed through random selection for both reviewers and task assignments, ensuring that intermediary agencies that assist with applications cannot influence their own cases.

Companies caught submitting falsified materials risk losing their certification and face a three-year ban on reapplication. Intermediary agencies engaged in misconduct face enforcement by multiple regulatory bodies, with penalties and cases published on the national SME cultivation platform.

SRDI and Little Giant status confer extensive benefits—ranging from government subsidies and procurement access to preferential bank credit and inclusion in technology pilot programs. Notably, Lil Giant enterprises receive central government awards and local subsidies, which have sometimes exceeded the central awards, aiding their growth in strategic sectors like advanced manufacturing and next-gen IT.

The introduction of these patent screening protocols reflects China's push to maintain integrity, bolster innovation quality, and safeguard the certification programs that support industrial and technological resilience.

By the numbers:

  • 17,600+ national-level Little Giant enterprises as of 2026 — cultivated across key strategic sectors.
  • Three-year ban — companies lose certification and cannot reapply after falsification is detected.

What's next: Authorities are expected to refine and implement AI-powered review systems and continue unannounced inspections of SRDI enterprises under this enhanced patent screening regime.
